    CJP Yahya Afridi Emphasizes Strict Legal Procedures in PTI’s Medical Petition Case

    ISLAMABAD: The Chief Justice of Pakistan, Yahya Afridi, has conveyed a firm stance on adhering strictly to the established legal framework, signaling that no exceptional measures will be entertained outside the boundaries of the law. This directive comes amid ongoing discussions regarding the medical treatment of former Prime Minister Imran Khan, who is currently incarcerated. PTI leadership has been briefed on the Chief Justice’s position, underscoring the judiciary’s commitment to procedural correctness in handling sensitive petitions.

    Following a meeting on Friday between PTI Chairman Barrister Gohar Ali Khan and Chief Justice Afridi, senior party officials were updated on the outcome. Barrister Gohar Ali Khan reportedly sought expedited relief from the Supreme Court to facilitate the transfer of Imran Khan to a hospital of the party’s choosing in Islamabad. The request also included permission for Khan’s personal doctors to conduct examinations within the jail premises. However, the Chief Justice emphasized that such matters must be addressed through the appropriate judicial channels rather than seeking direct intervention from the apex court.

    It is important to note that the PTI’s plea aimed to have Imran Khan admitted to Shifa International Hospital for specialized eye treatment by retina experts. This petition was formally submitted earlier on February 25 by Khan’s legal counsel, Sardar Latif Khosa, under Order XXXV Rule 6 of the Supreme Court Rules, 2025. The application detailed the necessity for immediate medical attention, requesting that Khan’s personal physicians, Dr Faisal Sultan and Dr Asim Yousaf, be allowed to participate fully in the examination and treatment process. Additionally, the petition sought to guarantee that Khan’s family members would be kept informed and permitted reasonable access during his medical care.

    Despite the urgency expressed by PTI, the Supreme Court Registrar’s Office returned the petition on Friday, citing procedural grounds. The office referenced a prior Supreme Court order dated February 12, which directed that any grievances related to Khan’s medical treatment should be brought before the Islamabad High Court, where an appeal is currently pending. This response underscores the judiciary’s insistence on following due process and discourages bypassing established legal forums.

    The situation highlights the delicate balance the judiciary maintains between addressing humanitarian concerns and upholding the rule of law. The Chief Justice’s clear message to PTI leaders reinforces the principle that even high-profile cases must navigate the judicial system through proper procedures. As the Islamabad High Court continues to deliberate on the matter, all eyes remain on how the legal process will unfold, especially given the political sensitivities surrounding Imran Khan’s incarceration and health.
