    ICC Member States Remove Prosecutor Karim Khan Over Misconduct Allegations

    On Friday, the International Criminal Court’s member states voted to remove prosecutor Karim Khan following serious misconduct allegations. This decision came after the court’s executive bureau recommended his dismissal last month due to an inappropriate sexual relationship with a junior ICC lawyer.

    A significant majority of the ICC’s 125 member states supported the recommendation, resulting in Khan’s removal. Päivi Kaukoranta, president of the court’s governing body, confirmed that 82 states parties agreed Khan committed serious misconduct and breached his duties.

    Khan, 56, has denied any wrongdoing. His lawyer, Tayab Ali, stated that Khan intends to challenge the decision’s legality and fairness through all available legal channels. The dismissal immediately initiates the process to elect a new ICC prosecutor, though the replacement is not expected to be appointed before next year.

    Leila Sadat, a professor of international criminal law at Washington University, remarked that the swift removal of Khan allows the court to continue its crucial work on ongoing cases without the distraction of an embattled official.

    Notably, Khan’s dismissal coincides with renewed U.S. efforts to undermine the ICC. The United States, which is not a member of the court, has criticized the ICC as a threat to its sovereignty and has imposed sanctions on 11 ICC judges and prosecutors, including Khan. These sanctions relate to the ICC’s arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former defense minister Yoav Gallant, as well as a previous investigation into U.S. military actions in Afghanistan.

    During a visit to the Philippines, U.S. Secretary of State Marco Rubio condemned the ICC, describing some involved as “lunatics and crazies” and asserting that no U.S. officials would face trial there. State Department spokesperson Tommy Pigott welcomed Khan’s removal but emphasized that it would not affect the U.S. strategy to dismantle the ICC, calling the institution “irredeemably corrupt.”

    Kyra Wigard, assistant professor of law at Utrecht University, noted that while Khan’s removal enhances the ICC’s credibility by demonstrating accountability, the court still faces significant challenges. She highlighted the difficulty of restoring both internal and external confidence while maintaining an image of independence amid intense geopolitical pressure.

    Last week, Khan’s accuser publicly reiterated her claims in an interview, alleging a non-consensual sexual relationship with the prosecutor. Khan’s legal team has denied any sexual involvement with the junior lawyer.

    It is important to note that any active ICC arrest warrants remain in effect, as only ICC judges have the authority to revoke them. The court now moves forward, balancing its internal reforms with external political pressures.
