    KP Government Proposes Bill to Protect Kalash Marriage and Inheritance Laws

    The Khyber Pakhtunkhwa government has taken a significant step to preserve the ancient cultural and religious heritage of the Kalash people by preparing a draft legislation titled the “Kalash Marriage Act.” This proposed law aims to provide formal legal recognition to key aspects of the Kalash community’s social structure, including marriage, divorce, and inheritance.

    The Kalash Valley, known for its unique and centuries-old civilization, will benefit from this bill, which has already been submitted to the provincial assembly for consideration. The legislation sets the minimum marriage age at 18 years and mandates that all marriages be officially registered with the local village or neighborhood council.

    Additionally, the draft outlines clear procedures for divorce and separation. It grants wives the right to seek legal recourse in cases of abuse, failure to provide maintenance, or if the husband goes missing. The bill respects Kalash traditions by incorporating specific provisions related to marriage customs, inheritance rights, protections for widows, and penalties for violations.

    Notably, the draft stipulates penalties for breaches of the legal marriage age or consent requirements, including imprisonment for up to six months and fines reaching Rs50,000. Furthermore, falsifying or misrepresenting information during marriage registration could result in fines up to Rs100,000.

    In a significant development, the proposed law also ensures that marriages conducted before its enactment will receive legal protection, thereby safeguarding existing unions within the community.
