The chief commissioner of Islamabad has submitted an application to the Supreme Court, urging an expedited hearing of the review petition against the court’s August 18 directive to transfer PTI founder Imran Khan from Adiala jail to Shifa International Hospital. The petition calls for the court to reconsider, amend, or revoke its earlier order.
This petition challenges the decision to move Imran Khan from Adiala jail to a private medical facility, as well as the related instructions concerning his medical examination and treatment by a designated medical panel. It emphasizes that the issue extends beyond medical care, touching on legal and constitutional jurisdictional matters.
Notably, the application raises questions about judicial authority in light of the 27th Constitutional Amendment, alongside concerns linked to Article 175(2) and prison regulations. It further stresses that since the Supreme Court’s order was time-sensitive, an early hearing is essential.
The original August 18 ruling mandated Adiala Jail authorities to transfer Imran Khan to Shifa Hospital within two days for medical evaluation and treatment; this deadline lapsed on Wednesday. Additionally, the court ordered the formation of a medical board and required the presence of Imran’s sister, Dr. Uzma, and his personal physician during his assessment, with the family responsible for expenses.
Meanwhile, the government transferred Khan to Pakistan Institute of Medical Sciences (PIMS) late Thursday night, where he underwent examination before being returned to Adiala jail. PTI labeled this action as “contempt of court.” Subsequently, the government filed a review petition challenging the Supreme Court’s jurisdiction, arguing that the court overlooked relevant statutory provisions, resulting in a manifest error.
The government’s petition also noted that Imran Khan had been regularly examined by medical boards and contended that the court should have consulted medical experts before ordering his hospital transfer on health grounds.
In a significant development, Federal Information Minister Atta Tarar stated on social media that Khan is medically fit. He confirmed that a team of specialists, including an ophthalmologist, cardiologist, and physician, conducted a thorough examination and declared Khan healthy.
Meanwhile, PTI filed a contempt petition alleging violation of the Supreme Court’s order. The petition requests the initiation of contempt proceedings against those responsible, issuance of show-cause notices, and directions for their personal appearance before the court. Filed by PTI Secretary-General Salman Akram Raja and Uzair Bhandari on behalf of Dr. Uzma Khan, the petition seeks a declaration of contempt and appropriate punishment.
Furthermore, PTI demands the immediate transfer of Imran Khan to Shifa International Hospital for medical examination. The party also requests the appointment of a judicial officer or the formation of a local commission to supervise and ensure compliance with the court’s order.
