    AJK Election Commission Delays Presidential Poll Schedule Amid Legal Clarifications

    The Azad Jammu and Kashmir (AJK) Election Commission has encountered a significant delay in announcing the schedule for the upcoming presidential election. This postponement stems from the absence of a formal notification declaring the presidential office vacant, a crucial document required to initiate the electoral process within the stipulated constitutional timeframe.

    In a formal communication addressed to the Secretary of the AJK Legislative Assembly, the Election Commission highlighted that the instructions received regarding the presidential election lacked the necessary directives from the authorized authority. This omission has created uncertainty about the exact timeline for conducting the election, which is mandated by the region’s constitution to be held within 30 days of the presidency becoming vacant.

    It is important to note that the constitutional provisions clearly assign the responsibility of organizing and supervising the presidential election to the AJK Election Commission. The Chief Election Commissioner, who officially assumed office on February 20, 2026, is tasked with ensuring that the election process adheres strictly to legal and constitutional requirements. However, without the official vacancy notification, the Commission is unable to proceed with setting an election date.

    Adding to the complexity, the Commission’s Secretary emphasized that the 30-day period for holding the election begins only after the formal declaration of the vacancy is issued. Since this notification was missing from the communication sent to the Election Commission, they have formally requested clarification from the competent authorities. This step is intended to guarantee that the election process is conducted with full legal backing and in compliance with all constitutional mandates.

    Meanwhile, Sardar Tanveer, a prominent political figure, has confirmed that consultations regarding the election of the new AJK president have been completed. Despite this progress, the Election Commission’s inability to receive the official vacancy notification continues to stall the announcement of the election schedule. This delay has raised concerns among political circles and the public, who are keenly awaiting a transparent and timely presidential election in Azad Jammu and Kashmir.

    In summary, the AJK Election Commission remains committed to upholding the constitutional framework governing the presidential election. The current hold-up underscores the importance of clear communication and proper procedural documentation between the legislative and electoral bodies. Authorities are expected to resolve this issue promptly to facilitate a smooth and lawful transition of presidential power in Azad Jammu and Kashmir.
